TERMS AND CONDITIONS

• Only registered bidders over the age of 18 years old will be allowed to bid.
• All payments are to be made in US Dollars.
• All payments are to be made by; Wire Transfer, ACH or Cashiers Check payable to Cindy's Auction. All payment for items purchased must be made within 48 hours of sale completion.
• All items must be paid for in full before shipment or delivery.
• All items are sold FOB. Shipping cost and liability are the buyers responsibility.
• All items are at the buyers risk as soon as declared sold.
• For all animals sold outside the State of Origin, the buyer will be responsbile for the legal importation of animals into their state. Seller will assist with proper health papers. CHECK your State requirements before purchasing.
• The results on any future health test on livestock are not guaranteed. No animal is warranted to be free of Johnes or any other infectious disease.
• Registration papers for registered livestock will be transferred to the new owner at the seller's expense after payment has been received. Please register for bid number exactly the way you want the pedigree transferred. The transfer of all pedigrees is the responsbility of the seller to the buyer. Cindy's Auction does not assume any responsibility or liability in the proper transfer of registration papers.
• All cataloged items have been prepared by Cindy's Auction. from information provided by the seller(s) and is assumed accurate as presented to us. However, Cindy's Auction will in no way guarantee age, pedigree, or reproductive status of the animals selling. All exceptions taken and adjustments made are between buyer and seller.
• This sale will be controlled by an auction program. Cindy's Auction is not responsible for malfunction or system errors which cause a bid or bidders to fail to be recognized or registered.

DISCLAIMER: Any person bidding on items in this auction agrees to these terms and conditions and understands that, by bidding, they are entering into a binding contract between themselves and the seller(s) and that they will be held financially responsible for their actions. This includes those people representing parties not present at the sale unless approval is received from the auction company. Neither the owners, auctioneers, sale manager nor other affiliated personnel may be held responsible for any accidents that may occur. Cindy's Auction acts only as an agent between buyer and seller and may not be held responsible for any livestock or merchandise. It is to be clearly understood that Cindy's Auction and its representatives act only as a medium between buyer and seller, and may not be held liable, financially or otherwise, for any failure on the part of the same to fulfill any obligations set forth in this sale or for the truth of any warranties expressed or implied.
